Payment Authorization. You authorize Viasat to charge your credit card or debit card (“Card Payment”), or initiate an electronic funds transfer out of your bank account (“EFT Payment”) for payment of all or any portion of your Service fees, the Termination Fee, if applicable (and/or any other applicable termination fee) and any other amounts payable under this Agreement, until such amounts are paid in full, unless you live in a state where Viasat is required under applicable law to accept another method of payment or Viasat has agreed to accept another method of payment from you. In addition, if you are leasing your Equipment, receiving Voice, receiving Services through our Recovery Act Program, receiving Services through the CAF-II program, and/or receiving the Affordable Connectivity Program or Lifeline discounts, the Agreement incorporates, as applicable, the Lease Addendum, the EasyCare Addendum, the Voice Addendum, the Recovery Act Addendum, the Affordable Connectivity Program Addendum, the CAF-II Addendum, and/or the CAF-II Lifeline Addendum. You acknowledge that you have received, read, understand and agree to be bound by all of the terms and conditions set forth on each of the pages of this Agreement and the incorporated documents, as each of them may be updated from time to time. Payment Authorization. You authorize Viasat us to pay checks signed by you and charge the payments against the applicable Account. Only checks or other methods approved by us may be used to withdraw funds from your credit card or debit card (“Card Payment”)Account. You agree that it will be your responsibility to verify the accuracy of information appearing on any checks, deposit slips, or initiate an electronic funds transfer out of your bank account (“EFT Payment”) for payment of all or any portion of your Service fees, the Termination Fee, if applicable (and/or any other applicable termination fee) and any other amounts payable under this Agreement, until such amounts are paid in full, unless you live in a state where Viasat is required under applicable law to accept another method of payment or Viasat has agreed to accept another method of payment from you. This Agreement has 20 pages and incorporates Viasat’s Data Allowance Policy, Bandwidth Usage Policy, Unlimited Data Policy, Privacy Policies, Acceptable Use Policy, Network Management Policy, Viasat Shield Application End User Terms and Conditions Agreementforms, and your Internet Service plan details you agree that we will not be liable for any printing errors on any such forms. All checks, withdrawal forms, deposit slips, and restrictions as posted transfer instructions used in connection with any Account must be on xxx.xxxxxx.xxx/xxxxxforms that we provide or otherwise expressly approve. In additionYou agree to complete checks using a non-gel, black or dark blue ink that will readily transfer during any imaging of the check. We will not be liable for any resulting losses, and you agree to hold us harmless from such losses, if you fail to meet your obligations as set forth in this paragraph. Checks and debits are leasing presented against your Equipmentchecking account by posting transactions according to a processing schedule. To avoid fees, receiving Voiceyou should ensure that your Account contains sufficient available funds at all times to pay each of your transactions. In making distributions upon the death or disability of any Party, receiving Services through you agree that we may rely upon our Recovery Act Programrecords at the time of any such death or disability. If an instrument (check) contains contradictory terms, receiving Services through typewritten terms prevail over printed terms, handwritten terms prevail over both, and words prevail over numbers. If you issue a check drawn on your Account and a nonmember of RBFCU seeks to cash the CAF-II programcheck at a RBFCU branch, you agree that we may require the nonmember to provide appropriate physical and/or receiving documentary identification as a condition of cashing a check drawn on your Account. You also agree that we may refuse to cash a check, even if it is properly payable and proper identification is provided, and such refusal shall not constitute wrongful dishonor of your check. Further, you agree we have the Affordable Connectivity Program or Lifeline discounts, right to charge the Agreement incorporatesnonmember, as applicablea condition of cashing the check, a nonmember check cashing fee. This fee, which is reflected in our Fee Schedule, helps RBFCU cover the Lease Addendum, the EasyCare Addendum, the Voice Addendum, the Recovery Act Addendum, the Affordable Connectivity Program Addendum, the CAF-II Addendum, and/or the CAF-II Lifeline Addendumadditional costs and risks involved in cashing such a check for a nonmember. You acknowledge that you have received, read, understand and agree that a nonmember seeking to cash a check drawn on your Account retains the ability to deposit the check with their own financial institution which would result in your check being presented to us through normal check processing channels. For other members of RBFCU, you agree that we may refuse to cash a check drawn on your Account if the member seeking to cash the check at a RBFCU branch is not a member in good standing and you further agree such refusal (or other action such as requiring the check to be bound by all of deposited into the terms and conditions set forth on each of the pages of this Agreement and the incorporated documents, as each of them may be updated from time to time. Payment Authorization. You To the extent permitted by law, you hereby authorize Viasat us to charge your credit card initiate separate EFT/Credit Card charges from the account you identify and/or any replacement or debit card (“Card Payment”), or initiate an electronic funds transfer out of your bank substitute account (the “EFT PaymentAccount”) for the following amounts: (1) the payments shown above; (2) your monthly training fees and the cost of any monthly Services Add-Ons; (3) a $5 “no show” fee for failure to cancel a reservation at least 1 hour prior to the class start time; (4) a $25 returned item fee for any EFT charge that is returned unpaid or on a credit/debit card return; and (5) any other fee for Personal Training or other goods or services we provide you from time to time if you instruct us orally or in writing to xxxx the charge to your Account on file, as authorized by you at that time. You may cancel your EFT/Credit Card authorization for the payment of all monthly dues by giving us 30 days written notice of cancellation per the terms of this Agreement. I understand that these charges, listed above, will appear on my credit card statement and/or bank statement under the name of 5th GEAR FITNESS and I accept full financial responsibility for payment of these charges. I certify that the information that is stated above is true and accurate. The payments shall be drawn on or about the date or dates of the Payment Plan. The transactions on your bank statement will constitute receipts for payment on your account. I also agree to contact 5th GEAR FITNESS about any portion matter of your Service feeschargeback or stop payment that may pertain to this agreement in order to attempt to resolve the matter prior to stopping payment or charging back payment(s). This authorization shall remain in effect until the Purchaser and bank receive written notification from me of intent to terminate at such time and in such manner as to afford the Purchaser and bank reasonable opportunity to act (minimum 30 days). I understand that if the total amount owed to the Purchaser is increased, I authorize this plan to continue as long as the payment amount remains unchanged until the amount owed the Purchaser is paid off, or debit card unless the plan is terminated earlier by me as above. I understand any added amounts can be applied for with a new ACH Debit Authorization Form. All other changes such as payment amount, frequency, bank account number change, will require a new ACH Debit Payment Authorization Form to be filled out and submitted to Merchant 15 days prior to any change being implemented.
