Payment by Pool Debtor Sample Clauses

Payment by Pool Debtor. Without prejudice to its obligations in respect of supplies of electricity in accordance with the provisions of the Agreement, each Pool Debtor shall without defence, set-off or counterclaim (but without prejudice to any other rights or remedies available to such Pool Debtor) make payment on the relevant Payment Date of the full amount (including United Kingdom Value Added Tax) so notified as being payable by it for the account of those Pool Members and, as the case may be, the Ancillary Services Provider so notified as being entitled to receive payments. Payment shall be made in accordance with the terms of this Schedule. For the avoidance of doubt no payment made shall be treated as being paid on account or subject to any condition or reservation, notwithstanding the provisions for the making of subsequent adjusting payments provided in this Schedule. The provisions of sub-section 5.14 shall apply to any payment insofar as it is or may constitute an overpayment.
