Payment During Delivery Event. After the Commercial Operation Date, to the extent that Seller is prevented from delivering Contract Capacity and Energy when Facility is available as a result of a Delivery Event, then Department shall remain obligated to pay the Capacity Payment for the period of such Delivery Event.
