Common use of PAYMENT OF BACK PAY CLAIMS Clause in Contracts

PAYMENT OF BACK PAY CLAIMS. If the Employer fails to give an employee pay to which he/she was entitled, and a written notice of his/her claim is filed within sixty (60) days of the time the Employer first failed to give him/her such pay, the Employer will reimburse him/her for the earnings he/she lost through such failure. If the Employer fails to give an Employee pay to which he/she was entitled as the result of an error by the Employer, the Employer shall make the employee whole for monies lost. A written notice of the claim in this circumstance must be filed within one year of the time the Employer failed to give him/her such pay. In all other cases, the sixty (60) day time period shall apply.
