Payment of Charges and Adjustments. 4.1 Charges payable regardless of remedies (a) except to the extent that clause 5.3 applies; (b) unless and until, and to the extent that, it is determined through dispute resolution or agreed that the charges are not payable pursuant to clause 13.4(b); and (c) unless a relevant Delay is caused by Wilful Default by DBCT Management (clause 13.5).
