Common use of Payment of Performance Unit Award for the Performance Period Clause in Contracts

Payment of Performance Unit Award for the Performance Period. Subject to early termination of this Award Agreement pursuant to Section 7 or Section 8 below, as soon as practicable following the end of the Performance Period and the determination of the Company’s Total Stockholder Return as compared to the Total Stockholder Return of the Peer Companies over the Performance Period, the Company will pay in cash to Employee the Performance Unit Award amount, if any, determined pursuant to Section 4(b) above.

Payment of Performance Unit Award for the Performance Period.
