Common use of Payment to BNPLC Clause in Contracts

Payment to BNPLC. All amounts payable under the preceding Paragraphs 2(a) or 2(c) by 3COM and, if applicable, by the Applicable Purchaser must be paid directly to BNPLC, and no payment to any other party shall be effective for the purposes of this Agreement. In addition to the payments required under Paragraph 2(a) hereunder, on the Designated Sale Date 3COM must pay all amounts then due to BNPLC under the Lease. BNPLC will remit any excess amounts due 3COM pursuant to the last sentence of clause (ii) of Paragraph 2 (a) promptly after BNPLC's receipt of the same and in no event later than thirty (30) days thereafter.

In addition to the payments required under Paragraph 2(a) hereunder, on the Designated Sale Date 3COM Informix must pay all amounts then due to BNPLC under the Lease. BNPLC will remit any excess amounts due 3COM Informix pursuant to the last sentence of clause (ii) of Paragraph 2 (a) promptly after BNPLC's receipt of the same and in no event later than thirty (30) days thereafter.
