Common use of PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES Clause in Contracts

PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES. 10.2.1 Procedures for payments for Additional Services may be made based on percentage completion of a Lump Sum Amount or according to hourly rates provided that, in any event, Additional Services shall be separately itemized on Engineer’s statement. Engineer expressly waives any right to payment for any Additional Services rendered if Engineer does not give written notice of its claim that the services are Additional Services prior to rendering such services and if such services are not billed as Additional Services within ninety (90) calendar days following their initiation. The method for computing the amount of Additional Services is described in Exhibit C. 10.2.2 Hourly Rates for compensation in Exhibit C include the direct salaries and wages of the Engineer’s personnel and its Consultants engaged on the Project and the portion of the cost of their mandatory and customary contributions and benefits related thereto, including, but not limited to, employment taxes and other statutory employee benefits, insuring sick leave, holidays, vacations and employee retirement plans, allocable to this Project as well as overhead and profit. Engineer’s hourly rates shall include all professional time and all clerical, administrative, overhead, insurance, reproduction, telephone, and transportation expenses. Engineer’s hourly rates, including the Engineer’s Consultant rates accepted by the City, shall remain constant throughout the duration of the Project, including in-house staff that may be promoted.
