Common use of Payments to Nominated Subcontractors Clause in Contracts

Payments to Nominated Subcontractors. For all work executed or goods, materials, Plant or services supplied by any nominated Subcontractor, the Contractor shall be entitled to: (a) the actual price paid or due to be paid by the Contractor, on the instructions of the Engineer, and in accordance with the subcontract; (b) in respect of labour supplied by the Contractor, the sum, if any, entered in the Bill of Quantities or, if instructed by the Engineer pursuant to paragraph (a) of Sub-Clause 16.2.2, as may be determined in accordance with Clause 13.3,13.4 and 13.5; and (c) in respect of all other charges and profit, a sum being a percentage rate of the actual price paid or due to be paid calculated, where provision has been made in the Bill of Quantities for a rate to be set against the relevant Provisional Sum, at the rate inserted by the Contractor against that item or, where no such provision has been made, at the rate inserted by the Contractor in the SCC and repeated where provision for such is made in a special item provided in the Bill of Quantities for such purpose.
