Plant and Equipment. The plants, structures and ------------------- equipment of the Company are structurally sound with no known defects and are in good operating condition and repair and are adequate for the uses to which they are being put. None of such plants, structures or equipment are in need of maintenance or repairs except for ordinary, routine maintenance and repairs which are not material in nature or cost. The Company has not received notification that it is in violation of any applicable building, zoning, anti- pollution, health or other law, ordinance or regulation in respect of its plants or structures or their operations.

Plant and Equipment. All Plant and Equipment listed in schedule 9 and currently in use in the Business is: (a) in good working order; (b) capable of doing the job for which it is now being used; and (c) in reasonable condition having regard to its age and fair wear and tear.
Plant and Equipment a. The contractor shall have sufficient plant, equipment and labor and shall work such hours and shifts as may be necessary to maintain the progress on the work as per the approval progress schedule. The working and shifts hours shall comply with the Govt. Regulations in force. b. It is to expressly and clearly understood that contractor shall make his own arrangements to equip himself with all machinery and special tools and plant for the speedy and proper execution of the work and the department does not undertake responsibility towards their supply. c. The department shall supply such of the machinery that may be available on hire basis but their supply cannot d. be demanded as matter of right and no delay in progress can be attributed to such non-supply of the plant by the department and the department cannot be made liable for any damage to the contractor. The Contractor shall be responsible for safe custody of the departmental machinery supplied to him (which will be delivered to contractor at the machinery yard at site of work) and he has to make good all damages and losses if any other than fire, wear and tear to bring it to the conditions that existed at the time of issue to the contractor before handing over the same to the department. The hire charges for the machinery handed over to the contractor will be recovered at the rate prevalent at the time of supply. The contractor will have to execute supplemental agreement with Executive Engineer at the time of supply of the machinery. d. The acceptance of departmental machinery on hire is optional to the contractor.

The Supplier agrees to supply, at its own expense and risk, all labour, plant, equipment, tools, appliances or other property and items it requires to fulfil its obligations under this Agreement. 6.2. Any plant, equipment, tools, appliances or other property and items that the Company provides to the Supplier to enable it to complete this Agreement remain the Company’s property and must only be used for the purposes of fulfilling the Supplier’s obligations under this Agreement. 6.3. The Supplier must keep the Company’s property in good working order and condition. 6.4. The Supplier is responsible and must compensate the Company for any loss or damage to any Site or Company property to the extent it was caused or contributed to by the Supplier or its Personnel.

Plant and Equipment. 1.1 The plant and equipment installed at or near the Premises Supply Meter Point comprises the following: (i) the National Grid Gas Minimum Offtake Facilities: [ ]mm valve and associated monitoring and control equipment installed at or immediately upstream of the Premises Supply Meter Point; (ii) the Operator Offtake Facilities: plant and equipment installed and owned by the Operator for purposes connected with the offtake of gas from the System and including filters [pre-heaters], [regulators,] measurement [and telemetry] equipment and all associated pipework and equipment installed at or immediately downstream of the Premises Supply Meter Point. as described in more detail in Annex B. 1.2 For the purposes of determining the period referred to in Section J4.4.5(b)(ii) (and without prejudice to Clause 7.1), where National Grid Gas has been notified of a requirement for maintenance of or failure or defect in the National Grid Gas Minimum Offtake Facilities: (a) National Grid Gas will: (i) arrange for an engineer to attend at the National Grid Gas Minimum Offtake Facilities within six (6) hours after National Grid Gas being so notified for the purposes of assessing the maintenance, repair or replacement works required; and (ii) unless such works can be carried out by the engineer upon such visit, prepare and submit to the Operator and Relevant Shipper(s) a programme for the carrying out of the works with all reasonable diligence; (b) where the engineer carries out such works upon such visit, the period referred to in that Section shall be deemed to expire when such works are completed; (c) except as provided in paragraph (b), the period referred to in that Section will be the period expiring at the end of the period provided for in the programme provided under paragraph (a)(ii), with any reasonable extensions necessitated by any failure of the Operator to provide reasonable access and co-operation to National Grid Gas in the carrying out of the required works. 1.3 The pre-heating equipment specified on the diagram in Annex B will be set to indicate a temperature of gas made available for offtake of [ ] degrees Celsius [( ) oC.]

Plant and Equipment a. The Concessionaire shall provide all machinery, plant and equipment necessary to complete the Works. All its Equipment shall, when brought on to the Project Site, be deemed to be exclusively intended for the execution of the works. b. The Concessionaire shall maintain an adequate inventory of consumable and spare parts, and undertake periodic and preventive maintenance as required for the relevant equipments. The Concessionaire shall ensure continuous work flow as required under the program. Breakdown of machinery or equipment shall not be a valid reason for any delay, extension in the Concession Period or addition of cost, towards the Project.
Plant and Equipment. Except as set forth in Schedule 3.25 and except for ordinary wear and tear, the plants, structures and equipment of the Company are in good operating condition and repair in all material respects, comply in all material respects with Pamphlet 58 and applicable state law, and are adequate for the uses to which they are being put, except where non-compliance would not have a material adverse effect on the Company and its Subsidiaries. The Company has received no notification that it is in violation of any applicable building, zoning or other law, ordinance or regulation in respect of its plants and or structures or their operations and, to the Company's Knowledge, no such violation exists. Except as set forth in Schedule 3.25, the Company has received no recommendation from any insurance carrier or any consultant hired by the Company proposing changes in its methods of operation or relating to changes with respect to any of the Company's properties, including the Real Estate or the properties leased under the Real Estate Leases (excluding information received from any insurance carrier mailed to its customers or the public generally).
Plant and Equipment. Except as set forth in Section 4.15 of the Disclosure Schedule, the plants, structures and equipment owned or used by the Business and each Seller's Domestic Subsidiary and to the Knowledge of Seller with respect to the Seller's Foreign Subsidiaries, have no known defects and, to the Knowledge of Seller are in good operating condition and repair and are adequate for the uses to which they are being put. To the Knowledge of Seller, none of such plants, structures or equipment are in need of maintenance or repairs except for ordinary, routine maintenance and repairs which are not material in nature or cost. Neither Seller (with respect to the Business) nor any Seller's Domestic Subsidiary, nor to Seller's Knowledge with respect to the Seller's Foreign Subsidiaries, has received notification that it is in violation of any applicable building, zoning, health or other law, ordinance or regulation in respect of its stores, plants or structures or their operations or the Real Property.
