Common use of Payments to Owner Trustee; Other Parties Clause in Contracts

Payments to Owner Trustee; Other Parties. After the Trust Indenture shall have been discharged pursuant to Section 10.01 thereof, any payment of the type referred to in Section 4.01(a) hereof (other than Excluded Payments) received by the Owner Trustee, any payments received from the Indenture Trustee other than as specified in Section 4.01(d) hereof and any other amount received as part of the Trust Estate and for the application or distribution of which no provision is made herein, shall be distributed forthwith upon receipt by the Owner Trustee in the following order of priority: first, so much of such payment as shall be required to reimburse the Owner Trustee for any expenses not otherwise reimbursed as to which the Owner Trustee is entitled to be so reimbursed pursuant to the provisions hereof shall be retained by the Owner Trustee; second, so much of the remainder for which provision as to the application thereof is contained in the Lease or any of the other Operative Documents shall be applied and distributed in accordance with the terms of the Lease or such other Operative Document; and third, the balance, if any, shall be paid to the Owner Participant.

After the Trust Indenture shall have been discharged pursuant to Section 10.01 thereofExcept as otherwise provided in subsections (b) and (c), all Basic Rent, Supplemental Rent, insurance proceeds and requisition, indemnity or other payments of any payment of the type referred to kind, in Section 4.01(a) hereof (other than Excluded Payments) received by the Owner Trustee, any payments received from the Indenture Trustee other than as specified each case included in Section 4.01(d) hereof and any other amount received as part of the Trust Estate and for the application or distribution of which no provision is made hereinreceived by Owner Trustee, shall be distributed forthwith upon receipt by the Owner Trustee in the following order of priority: first, so much of such payment as shall be required to pay or reimburse the Owner Trustee for any fees or expenses not otherwise paid or reimbursed as to which the Owner Trustee is entitled to be so paid or reimbursed pursuant to the provisions hereof or of the other Operative Documents shall be retained by the Owner Trustee; second, so much of the remainder for which provision as to the holding, application or distribution thereof is contained in the Lease or any of the other Operative Documents Document shall be held, applied and or distributed in accordance with the terms of the Lease or such other Operative Document; and third, the balance, if any, shall be paid to Owner Participant. Nothing herein is intended to limit or restrict the payment of the Security Deposit to the Owner Participant.

After the Trust Indenture shall have been discharged pursuant to Section 10.01 thereofExcept as otherwise provided in subsections (b) and (c), all Basic Rent, Supplemental Rent, insurance proceeds and requisition, indemnity or other payments of any payment of the type referred to kind, in Section 4.01(a) hereof (other than Excluded Payments) received by the Owner Trustee, any payments received from the Indenture Trustee other than as specified each case included in Section 4.01(d) hereof and any other amount received as part of the Trust Estate and for the application or distribution of which no provision is made hereinreceived by Owner Trustee, shall be distributed forthwith upon receipt by the Owner Trustee in the following order of priority: first, so much of such payment as shall be required to pay or reimburse the Owner Trustee for any fees or expenses not otherwise paid or reimbursed as to which the Owner Trustee is entitled to be so paid or reimbursed pursuant to the provisions hereof or of the other Operative Documents shall be retained by the Owner Trustee; second, so much of the remainder for which provision as to the holding, application or distribution thereof is contained in the Lease or any of the other Operative Documents Document shall be held, applied and or distributed in accordance with the terms of the Lease or such other Operative Document; and third, the balance, if any, shall be paid to Owner Participant. After the Trust Indenture Security Agreement shall have been discharged pursuant to Section 10.01 11.5 thereof, any payment of the type referred to in Section SECTION 4.01(a) hereof (other than Excluded Payments) received by the Owner Trustee, any payments received from the Indenture Lender or Security Trustee other than as specified in Section SECTION 4.01(d) hereof and any other amount received as part of the Trust Estate and for the application or distribution of which no provision is made herein, shall be distributed forthwith upon receipt by the Owner Trustee in the following order of priority: firstFIRST, so much of such payment as shall be required to reimburse the Owner Trustee for any expenses not otherwise reimbursed as to which the Owner Trustee is entitled to be so reimbursed pursuant to the provisions hereof shall be retained by the Owner Trustee; secondSECOND, so much of the remainder for which provision as to the application thereof is contained in the Lease or any of the other Operative Documents Agreements shall be applied and distributed in accordance with the terms of the Lease or such other Operative DocumentAgreement, to the extent such remainder was not previously paid pursuant to the terms of such other Operative Agreements; and thirdTHIRD, the balance, if any, shall be paid to the Owner Participant.
