Payments to Sponsor. Except as provided under this Agreement, the Sponsor shall have no right to retain or divert to others any of the Trust assets before all payment of benefits have been made to Participants pursuant to the terms of the Plan.
Payments to Sponsor. No payment to the Sponsor, or to any affiliated person or agent of the Sponsor, shall be allowed the Custodian as an expense except for payment to the Sponsor of the expenses incurred by it in connection with the duties delegated to it as described in the immediately preceding paragraph.

Payments to Sponsor. Except as provided under this Agreement, the Sponsor shall have no right to retain or divert to others any of the Trust assets before all payment of benefits have been made to Participants pursuant to the terms of the Plan. Notwithstanding the foregoing, in the event that the Administrator determines that the amount of assets held in the Trust with reference to a particular Participant exceeds the obligation of the Participant’s Employer to such Participant under the Plan, the Trustee shall disburse such excess amount to the Administrator as directed by the Administrator. The Trustee shall have no responsibility for determining the accuracy of the Administrator’s calculations of such excess amounts.
