Pending Treatments. Notwithstanding Subsection 4.1(a) above, all courses of treatment that have begun prior to the Distribution Date with respect to Roxio Employees (or their eligible dependents) under the applicable Adaptec Health Plan shall be provided without interruption under the applicable Adaptec Health Plan until the earlier of: (i) such course of treatment is concluded or discontinued or (ii) ninety (90) days from the date medical attention was first received with respect to such course of treatment ("Uninterrupted Treatment"). For purposes of this Section 4.1(b) only, courses of treatment means that a Roxio Employee, prior to the Distribution Date, has received, and at the Distribution Date is still receiving, medical treatment for a specific illness or injury and such Uninterrupted Treatment is applicable only to that specific illness or injury.

Pending Treatments. Notwithstanding Subsection 7.1(a) above, all treatments which have been pre-certified for or are being provided to an AMO Transferred Employee or AMO Beneficiary as of the Distribution Date shall be provided without interruption under the appropriate Allergan Plan (to the extent such continued treatment is not provided under an AMO Plan as of the Distribution Date) until such treatment is concluded or discontinued pursuant to applicable Plan rules and limitations, but AMO shall continue to be responsible for all liabilities relating to, arising out of, or resulting from such on-going treatments as of the Distribution Date.
Pending Treatments. Notwithstanding Subsection 6.2(a) above, all ------------------ treatments which have been pre-certified for or are being provided to an Agilent Transferred Employee as of the Distribution Date shall be provided without interruption under the appropriate HP Health and Welfare Plan until such treatment is concluded or discontinued pursuant to applicable Plan rules and limitations, but Agilent shall continue to be responsible for all Liabilities relating to, arising out of, or resulting from such on-going treatments as of the Distribution Date.
Pending Treatments. Notwithstanding Section 5.3(a) above, all treatments which have been pre-certified for or are being provided to an eFunds Employee as of the Distribution Date shall be provided without interruption under the appropriate Deluxe Health and Welfare Plan until such treatment is concluded or discontinued pursuant to applicable Plan rules and limitations, but eFunds shall continue to be responsible for all liabilities relating to, arising out of, or resulting from such on-going treatments as of the Distribution Date and shall reimburse Deluxe or the Deluxe Health and Welfare Plan for the costs of such treatment to the extent that the cost of such treatments have been paid by Deluxe or the Deluxe Health and Welfare Plan.
Pending Treatments. Notwithstanding Subsection 6.01(a) above, all treatments which have been pre-certified for or are being provided to a Southern Energy Employee or his or her spouse or dependents as of the Group Status Change Date shall be provided without interruption under the appropriate Southern Health and Welfare Plan until such treatment is concluded or discontinued pursuant to applicable Plan rules and limitations provided the affected Southern Energy Employee (or his or her spouse or dependents) elect to continue coverage after the Group Status Change Date as provided in Subsection 6.03(a)(i) below and timely pay the cost of coverage associated with such election.
Pending Treatments. Notwithstanding Section 4.1(a) above, all courses of treatment under the applicable LSI Logic Health Plan that have begun on or prior to the earlier of the Distribution Date or the Control Cessation Date with respect to SSI Employees (or their eligible dependents) who are hospitalized on the Distribution Date, or the Control Cessation Date, as applicable, shall be provided without interruption under the applicable LSI Logic Health Plan until the end of such hospitalization (“Uninterrupted Hospitalization Treatment”). For purposes of this Section 4.1(c) only, hospitalization is as defined under the applicable Health Plan and courses of treatment means that a SSI Employee (or his or her eligible dependent), on or prior to the Distribution Date, or the Control Cessation Date, as applicable, is receiving medical treatment for the specific illness or injury for which he or she is hospitalized on the Distribution Date, or the Control Cessation Date, and such Uninterrupted Hospitalization Treatment is applicable only to that specific illness or injury.
Pending Treatments. Notwithstanding Subsection 5.1(a) above, all treatments which have been pre-certified for or are being provided to a Palm Transferred Employee as of the Distribution Date shall be provided without interruption under the appropriate 3Com Health Plan (to the extent such continued treatment is not provided under a Palm Health Plan) until such treatment is concluded, discontinued, or, if earlier, through December 31, 2000, pursuant to applicable Health Plan rules and limitations, but Palm shall continue to be responsible for all Liabilities relating to, arising out of, or resulting from such on-going treatments as of the Distribution Date.

For purposes of this Section 4.1.2 only, courses of treatment means that a Education Employee, prior to the Distribution Date, has received, and at the Distribution Date is still receiving, medical treatment for a specific illness or injury and such Uninterrupted Treatment is applicable only to that specific illness or injury.
Pending Treatments. Schedule 8.17 contains (i) a list of all requests for prior authorization of treatment to be provided to Commercial Members pending with the Seller as of the date hereof, including the date, detailed nature and status of each such request, and (ii) a list of all previously authorized organ transplants that are yet to be provided to Commercial Members and all other previously authorized treatments that are yet to be provided to Commercial Members the claims expense for which is likely to exceed $5,000, including the date of authorization and a detailed case description. The Seller has engaged in no acts or omissions having the effect of delaying the authorization or scheduling of health care services provided to Commercial Members in a manner inconsistent with customary industry practices or Article 49 of the Public Health Law.
