Common use of PERFORMANCE ACCOUNTABILITY Clause in Contracts

PERFORMANCE ACCOUNTABILITY. a. PROVIDER, commencing as of the date of execution of this agreement by both parties, shall perform all the functions set forth in the agreement scope of services. Adequate performance under this agreement is essential and PROVIDER shall measure its performance results against goals and performance standards provided by this agreement. Measured performance below goals standards will constitute noncompliance with the terms of this agreement.
