Common use of Performance by Affiliates Clause in Contracts

Performance by Affiliates. Notwithstanding anything to the contrary set forth herein, either Party will have the right to perform any or all of its obligations and exercise any or all of its rights under this Agreement through any Affiliate. Each Party hereby guarantees the performance by its Affiliates of such Party’s obligations under this Agreement, and will cause its Affiliates to comply with the provisions of this Agreement in connection with such performance.

Performance by Affiliates. Notwithstanding anything any provision to the contrary set forth hereinin this Agreement, either Party will have the right to perform any or all of its obligations and exercise any or all of its rights under this Agreement through any Affiliate. Each Party hereby guarantees the performance by its Affiliates of such Party’s obligations under this Agreement, Agreement and will cause its Affiliates to comply with the provisions of this Agreement in connection with such performance.

Performance by Affiliates.
