PERFORMANCE BY LANDLORD OF TENANT'S OBLIGATIONS. (a) Landlord's Self Help. If Tenant shall default in the performance of any term, provision, covenant or condition on its part to be performed hereunder and such default shall be continuing, Landlord may, after Notice to Tenant and a reasonable time to perform after such Notice (or without Notice and additional time to perform if, in Landlord's reasonable opinion, an emergency exists or action is necessary to cure any default under the Facility Mortgage prior to the expiration of the applicable cure period therefor) perform the same for the account and at the expense of Tenant. If, at any time and by reason of such Event of Default, Landlord is compelled to pay, or reasonably elects to pay, any sum of money or do any reasonable act which will require the payment of any sum of money, or is compelled to incur any expense in the enforcement of its rights hereunder or otherwise, such sum or sums, together with interest thereon at the Overdue Rate, shall be deemed additional rent hereunder and shall be paid to Landlord by Tenant promptly when billed therefor, and Landlord shall have all the same rights and remedies in respect thereof as Landlord has in respect of the Rent herein reserved.
