Common use of Performance Incentive Compensation Clause in Contracts

Performance Incentive Compensation. 6.1. During each Contract Year, Coach will be eligible to receive performance incentive compensation for achieving annual specified performance goals (“Performance Goals”) in the amounts set forth in Appendix C (“Incentive Compensation”), provided Coach meets the Performance Incentive Criteria, as that term is defined herein, during each Contract Year. Any such Incentive Compensation shall be prospective, compensating Coach only for services and events which have not occurred at the time of the signing of this Agreement. Any Incentive Compensation provided will be (a) subject to any conditions, limits or restrictions as set forth in this Agreement; (b) subject to any conditions, limits, or restrictions of University Rules; and (c) subject to the availability of adequate funding. All determinations of whether adequate funding is available shall be determined by the Director of Athletics, in his/her sole discretion. Incentive Compensation shall be payable by June 30 of each Contract Year in which it was earned.
