Common use of PERFORMANCE OF OBLIGATIONS OF LESSEE BY LESSOR Clause in Contracts

PERFORMANCE OF OBLIGATIONS OF LESSEE BY LESSOR. In the event that Lessee shall fail duly and promptly to perform any of its obligations under the provisions of this Lease, Lessor may, at its option, perform the same for the account of Lessee without thereby waiving such default, and any amount paid or expense (including reasonable attorneys' fees), penalty or other liability incurred by Lessor in such performance, together with interest at the Overdue Rate until paid by Lessee to Lessor, shall be payable by Lessee upon demand as additional rent for the Aircraft.

In the event that If Lessee shall fail duly and promptly to perform any of its Lessee's obligations under the provisions of Article 5 of this Leaselease, Lessor may, at its option, at any time thereafter perform the same for the account of Lessee without thereby waiving such the default, and any amount paid expense or expense (including reasonable attorneys' fees), penalty or other liability incurred by Lessor in such performanceby so doing, together with interest at one percent (1%) per month or the Overdue Rate highest lawful rate, whichever is less, until paid by Lessee to Lessor, shall be payable by Lessee upon demand as additional rent for the Aircraft.
