OBLIGATIONS OF LESSEE. The Lessee shall be primarily responsible whenever needed for the maintenance and general pickup of the entranceway leading into the Premises, so that this is kept in a neat, safe and presentable condition. The Lessee shall also be responsible for all minor repairs and maintenance of the leasehold Premises, particularly those items which need immediate attention and which the Lessees, or their employees, can do and perform on their own, including but not limited to, the replacement of light bulbs, as well as the normal repair and cleaning of windows, cleaning and clearing of toilets, etc., and the Lessee shall properly maintain the Premises in a good, safe, and clean condition. The Lessee shall properly and promptly remove all rubbish and hazardous wastes and see that the same are properly disposed of according to all local, state or federal laws, rules regulations or ordinances. In the event the structure of the Premises is damaged as a result of any neglect or negligence of Lessee, their employees, agents, business invitees, or any independent contractors serving the Lessee or in any way as a result of Lessee’s use and occupancy of the Premises, then the Lessee shall be primarily responsible for seeing that the proper claims are placed with the Lessee’s insurance company, or the damaging party's insurance company, and shall furthermore be responsible for seeing that the building is safeguarded with respect to said damage and that all proper notices with respect to said damage, are made in a timely fashion, including notice to the Lessor, and the party or parties causing said damage. Any damage that is not covered by an insurance company will be the liability of the Lessee. The Lessee shall, during the term of this Lease, and in the renewal thereof, at its sole expense, keep the interior of the Premises in as good a condition and repair as it is at the date of this Lease, reasonable wear and use excepted. This obligation would include the obligation to replace any plate glass damaged as a result of the neglect or acts of Lessee or her guests or invitees. Furthermore, the Lessee shall not knowingly commit nor permit to be committed any act or thing contrary to the rules and regulations prescribed from time to time by any federal, state or local authorities and shall expressly not be allowed to keep or maintain any hazardous waste materials or contaminates on the Premises. OBLIGATIONS OF LESSEE. In addition to and not in derogation or substitution of any of its other obligations under this Agreement, the Lessee shall throughout the Term hereof comply with the following obligations:
OBLIGATIONS OF LESSEE. LESSEE shall maintain and operate the LEASED LAND and all improvements placed thereon at LESSEE’S sole cost and expense. Under no circumstances shall the BOARD bear any cost or expense. XXXXXX accepts the LEASED LAND in its present condition. XXXXXX declares and xxxxxx agrees that he is leasing and that he is not relying on any representations made by the BOARD or its agents as to location, value, future value, income therefrom or its production. LESSEE shall pay any taxes levied against the LEASED LAND when due and shall not allow such taxes to become delinquent. If the LESSEE fails to pay any such taxes when due, then the BOARD may, but is not obligated to, pay any delinquent taxes on account for the LEASED LAND and may terminate this lease. If the BOARD pays any delinquent taxes on behalf of the LESSEE, then the LESSEE shall reimburse the BOARD in full, with interest at the highest rate allowed by law. The LESSEE’s obligation to pay delinquent taxes, and its obligation to reimburse the BOARD for payment of delinquent taxes, survive the termination of this lease and remain binding on the LESSEE until paid in full. LESSEE shall pay for all utility expenses on the LEASED LAND, including, but not limited to, electricity, water, sewerage, and garbage services. LESSEE shall, at its sole cost and expense, maintain the LEASED LAND and improvements in good condition, free of refuse, debris, and in orderly fashion and shall control weeds and vegetation without allowing them to go to seed. LESSEE shall allow no hazardous waste on the LEASED LAND whatsoever. LESSEE shall provide a complete and proper arrangement for sanitary disposal of all refuse and shall adhere to all BOARD requirements. LESSEE shall not store or pile any wood, containers, or any item of personal property upon the LEASED LAND. LESSEE shall not start or taxi aircraft within any aircraft hangar. LESSEE shall not maintain billboards or advertising signs except as approved in writing in advance by the BOARD. XXXXXX shall not use spray paint on the LEASED LAND exterior, except upon prior approval in writing by the Park County Commissioners. LESSEE shall keep and maintain in good repair on the LEASED LAND fire suppression equipment consisting of an appropriate fire extinguisher. LESSEE shall not use the LEASED LAND for livestock operations. LESSEE shall not use the LEASED LAND for residential purposes. OBLIGATIONS OF LESSEE. Lessee shall, at all times and at its sole expense, maintain in good repair and keep in a clean and orderly condition the appearance of the Premises, all Leasehold Improvements and Trade Fixtures therein, whether installed by Lessee or Lessor. All maintenance shall be equal to or better than the materials, workmanship and appearance representative of similar areas in the Airport directly controlled by Lessor. Lessee shall conduct regular and routine cleaning, inspections and maintenance within the Premises, any support space and the pathways in between, and shall provide documentation of the cleaning, inspections and maintenance when requested by the Lessor. To maintain high standards of maintenance throughout the Airport, Lessor shall have the right to accomplish any required work in the event of Lessee’s failure to do so and to charge Lessee for the labor and materials used at such rates as Lessor may establish provided, however, that Lessor, before commencing any required work within the Premises, shall give Lessee written notice of its default and a five (5) day period in which to correct any default.
OBLIGATIONS OF LESSEE. This Lease and the rights granted to Lessee by this Lease are and shall be subject and subordinate at all times to (a) all ground or underlying leases affecting all or any part of the Property now or later existing and all amendments, renewals, modifications, supplements and extensions of this Lease, and (b) all deeds of trust or mortgages now or later affecting or encumbering all or any part of the Property and/or any ground or underlying leasehold estate; provided, however, that if Lessor elects at any time to have Lessee’s interest in this Lease be or become superior, senior or prior to any such instrument, then upon receipt by Lessee of written notice of such election, this Lease shall be superior, senior and/or prior to such instrument. Lessee shall immediately execute all instruments and other documents required or desired by any lender or Lessor confirming the subordination and/or superiority, as applicable, of this Lease to such mortgage, deed of trust, ground or underlying lease.
