Common use of Periods and Seller’s Undertaking Clause in Contracts

Periods and Seller’s Undertaking. Subject to the general conditions and limitations set forth in Subclause 12.2.4 below, the Seller agrees that if a Failure occurs in an Item within twelve (12) years after the delivery of said Aircraft to the Buyer, the Seller will, at its own discretion, as promptly as practicable and for a price that reflects the Seller's financial participation as hereinafter provided, either:

Periods and Seller’s Undertaking. Subject to the general conditions and limitations set forth in Subclause 12.2.4 below, the Seller agrees that if a Failure occurs in an Item before the Aircraft in which such Item is installed has completed forty-three thousand two hundred (43,200) flying hours or twentyeight thousand eight hundred (28,800) landings or within twelve (12) years after the delivery of said Aircraft to the Buyer, whichever shall first occur, the Seller willshall, at its own discretion, as promptly as practicable and for a price that reflects the Seller's financial participation as hereinafter provided, either:
