Common use of PERMITS AND RESPONSIBILITIES Clause in Contracts

PERMITS AND RESPONSIBILITIES. The Contractor shall, without additional expense to HISD, be responsible for processing of drawings for approval by the applicable jurisdictions, and for obtaining all necessary licenses and permits (except as reflected below), and for complying with any Federal, State and municipal laws, codes, and regulations applicable to the performance of the Work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor’s or Subcontractor’s fault or negligence, and shall take proper safety and health precautions to protect the Work, the Workers, the public, and the property of others. The Contractor shall also be responsible for all materials delivered and Work performed until completion and acceptance of the entire Work, except for any completed unit of Work which may have been accepted in writing under this Contract. A. The Contractor shall pay sales, consumer, use and similar taxes for the Work provided by the Contractor which are legally enacted when bids are received or negotiations concluded, whether or not yet effective or merely scheduled to go into effect. HISD stipulates that it is an exempt organization as defined by the Limited Sales, Excise and Use Tax Act and as such is exempt from the payment of the sales tax on materials and supplies used in the performance of this Contract. The Contractor shall issue exemption certificates to its suppliers and Subcontractors in lieu of said sales tax for all such materials and supplies, and said exemption certificates must comply with current rulings of the Texas State Comptroller. B. Unless otherwise provided in this Contract, the Contractor shall secure and pay for all permits and governmental fees, licenses and inspections necessary for proper execution and completion of the Work which are customarily secured after execution of this Contract and which are legally required when bids are received or negotiations concluded. Notwithstanding the above, costs for building permits will be paid by HISD at actual cost. C. The Contractor shall comply with and give notices required by laws, ordinances, rules, regulations and lawful orders of public authorities applicable to performance of the Work. D. It is not the Contractor’s responsibility to ascertain that any construction documents prepared by HISD’s Architect/Engineer are in accordance with applicable laws, statutes, ordinances, building codes, and rules and regulations. However, if the Contractor observes that portions of the construction documents are at variance therewith, the Contractor shall promptly notify the Architect/Engineer and HISD Project Manager in writing, and necessary changes shall be accomplished by appropriate modification. E. If the Contractor performs Work knowing or which it should have reasonably known to be contrary to laws, statutes, ordinances, building codes, and rules and regulations without such notice to the Architect/Engineer and HISD Project Manager, the Contractor shall assume responsibility for such Work and shall bear all costs attributable to correction.

The 6.1 Job Order Contractor shall, without additional expense to HISD, shall be responsible for processing of drawings for for: approval by the applicable jurisdictions, and appropriate oversight bodies; for obtaining all any necessary licenses and permits (except as reflected below)permits; and, and for complying with any Federal, State and municipal laws, codes, and regulations applicable to regulations. Owner will reimburse Job Order Contractor for the actual, documented costs of construction permits required for the performance of the Work. The Job Order Contractor shall also be responsible for all damages to persons or property that occur as a result of the Job Order Contractor’s or Subcontractor’s fault or negligence, and shall take proper safety and health precautions to protect the Work, the Workersworkers, the public, and the property of others. The Job Order Contractor shall also be responsible for all materials delivered and Work work performed until completion and acceptance of the entire Work, except for any completed unit of Work which may have been accepted in writing under this the Contract. A. 6.2 The Job Order Contractor shall pay salesfully document its project activities, consumerin drawings, use reports, or other methods as appropriate to the Scope of Work. The Job Order Contractor shall bear the cost of providing all plans, specifications and similar taxes other documents used by Job Order Contractor and its consultants. 6.3 Owner shall furnish information and services relevant to the project and as reasonably necessary for the Work provided by the project. Job Order Contractor which are legally enacted when bids are received or negotiations concluded, whether or not yet effective or merely scheduled to go into effect. HISD stipulates that it is an exempt organization as defined by the Limited Sales, Excise and Use Tax Act and as such is exempt from the payment of the sales tax on materials and supplies used shall exercise reasonable care in relying upon this information in the performance of its services under this ContractAgreement. The Owner makes no warranties or representations as to the accuracy or suitability of information provided to the Job Order Contractor by the Owner or by others. Owner and Job Order Contractor shall issue exemption certificates to its suppliers render approvals and Subcontractors in lieu of said sales tax decisions as expeditiously as necessary for all such materials and supplies, and said exemption certificates must comply with current rulings the orderly progress of the Texas State Comptroller. B. Unless otherwise provided in this Contract, the Contractor shall secure Job Order Contractor’s services and pay for all permits and governmental fees, licenses and inspections necessary for proper execution and completion of the Work which are customarily secured after execution of this Contract and which are legally required when bids are received or negotiations concluded. Notwithstanding the above, costs for building permits will be paid by HISD at actual cost. C. The Contractor shall comply with and give notices required by laws, ordinances, rules, regulations and lawful orders of public authorities applicable to performance of the Work. D. It is not the 6.4 Owner shall assist Job Order Contractor’s responsibility , as reasonably necessary, in gaining entry to ascertain that any construction documents prepared by HISD’s Architect/Engineer are property as necessary for Job Order Contractor to perform its services under this Agreement. 6.5 Job Order Contractor shall perform all Work in accordance compliance with all applicable federal, state, municipal and State of Texas laws, statutesregulations, codes, ordinances, building codes, orders and rules and regulationswith those of any body having jurisdiction over the Work or project. However, if the Contractor observes that portions of the construction documents are at variance therewith, the Job Order Contractor shall promptly notify also be responsible for compliance with Owner’s rules, regulations and policies as they currently exist or as they may be amended or revised in the Architect/Engineer and HISD Project Manager in writing, and necessary changes shall be accomplished by appropriate modificationfuture. E. If the Contractor performs Work knowing or which it should have reasonably known to be contrary to laws, statutes, ordinances, building codes, and rules and regulations without such notice to the Architect/Engineer and HISD Project Manager, the Contractor shall assume responsibility for such Work and shall bear all costs attributable to correction.
