Permitted assignment and charges. 22.2.1. The restraints set forth in Clause 22.1 shall not apply to: a) liens arising by operation of law (or by an agreement evidencing the same) in the ordinary course of business of the Project; b) mortgages/pledges/hypothecation of goods/assets including Project Assets and their related documents of title, a charge on the Designated Bank Account, arising or created in the ordinary course of business of the Project, and as security only for indebtedness to the Lenders under the Financing Documents and/or for working capital arrangements for the Project; and c) liens or encumbrances required by any Applicable Law.

The restraints set forth in Clause 22.1 Article 28.1 shall not apply to: (a) liens arising by operation of law (or by an agreement evidencing the same) in the ordinary course of business of the Project; (b) mortgages/pledges/hypothecation of goods/assets including Project Assets and their related documents of title, a charge on the Designated Bank Account, arising or created in the ordinary course of business of the Project, and as security only for indebtedness to the Senior Lenders under the Financing Documents Agreements and/or for working capital arrangements for the Project; and c) liens or encumbrances required by any Applicable Law.;

The restraints set forth in Clause 22.1 28.1 shall not apply to: (a) liens arising by operation of law (or by an agreement evidencing the same) in the ordinary course of business of the Project; (b) mortgages/pledges/hypothecation of goods/assets including other than Project Assets Assets, and their related documents of title, a charge on the Designated Bank Account, title arising or created in the ordinary course of business of the Project, Project and as security only for indebtedness to the Lenders under lenders for financing the Financing Documents operation and maintenance of Project Facilities and/or for working capital arrangements for the Project; and (c) liens or encumbrances required by any Applicable Law.
