Common use of Permitted Statements Clause in Contracts

Permitted Statements. Nothing in this Employment Agreement shall restrict any Person from making truthful statements (provided any such statement does not include Confidential Information) (i) when required by law, subpoena, court order or the like; (ii) when requested by a governmental, regulatory, or similar body or entity; or (iii) in confidence to a professional advisor for the purpose of securing professional advice.

Permitted Statements. Nothing in this Employment Agreement shall restrict any Person from making truthful statements (provided any such statement does not include Confidential Information) (i) when required by law, subpoena, court order or the like; (ii) when requested requested, in a formal written request, by a governmental, regulatory, or similar body or entity; or (iii) in confidence to a professional advisor for the purpose of securing professional advice, provided that prior to disclosure, Executive shall notify his professional advisor of the confidential nature of the information and advise him/her to treat the information as confidential and subject to disclosure only pursuant to the exceptions set forth herein.
