PERSONAL DATA PROTECTION ACT. 7.1. PAH is committed to protecting the privacy, confidentiality and security of all personal data to which it is entrusted. It has been our policy to ensure your personal information are protected. With the introduction of the Malaysian Personal Data Protection Act 2010 ("PDPA"), we are even committed to ensure the privacy and confidentiality and security of all personal data are protected in line with the PDPA. We process personal data which you have provided to us voluntarily through our website upon your registration and this includes personal data such as your name, address, NRIC and contact details. In this regards, you have expressly consent to our processing of your personal data. If you give us personal data or information about another person, you must first confirm that he/she has appointed you to act for him/her, to consent to the processing of his/her personal data and to receive on his/her behalf any data protection notices. We may request your assistance to procure the consent of such persons whose personal data is provided by you to us and you agree to do so. You shall indemnify us in the event we suffer loss and damage as a result of your failure to comply with the same. We will only retain your personal data for as long as necessary for the fulfilment of the specified purposes or as legislated 7.2. E-Bidders shall be responsible for the confidentiality and use of password and not to reveal the password to anyone at any time and under any circumstances whether intentionally or unintentionally. 7.3. E-Bidders agree to comply with all the security measures related to safety of the password or generally in respect of the use of the service. In the event that the password is compromised, the E-Bidders shall immediately notify PAH.

It has been Auctioneers policy to ensure the Purchaser and/or the Purchaser’s Agent personal information is protected. With the introduction of the Malaysian Personal Data Protection Act 2010 ("PDPA"), Auctioneers are even committed to ensure the privacy and confidentiality and security of all personal data are protected in line with the PDPA. Auctioneers will process personal data which the Purchaser and/or the Purchaser’s Agent have provided to Auctioneers voluntarily through Auctioneers website upon the Purchaser and/or the Purchaser’s Agent registration and this includes personal data such as the Purchaser and/or the Purchaser’s Agent name, address, NRIC and contact details. PERSONAL DATA PROTECTION ACT. (a) If an Obligor provides a Finance Party with personal data (as defined in the Personal Data Protection Xxx 0000 of Singapore) of any individual as required by, pursuant to, or in connection with the Finance Documents, the relevant Obligor represents and warrants to the Finance Party that it has (i) notified the relevant individual of the purposes for which data will be collected, processed, used or disclosed; and (ii) obtained such individual’s consent for the collection, processing, use and disclosure of his/her personal data by the Finance Party, in each case, in accordance with or for the purposes of the Finance Documents and such other purposes as set out in the Finance Party’s privacy statement. (b) The relevant Obligor agrees and undertakes to notify (or procure to be notified to) the Finance Party promptly upon its becoming aware of the withdrawal by the relevant individual of his/her consent to the collection, processing, use and/or disclosure by the Finance Party of any personal data provided by the relevant Obligor to the Finance Party. (c) Any consent given pursuant to this Agreement in relation to personal data shall, subject to all applicable laws and regulations, survive death, incapacity, bankruptcy or insolvency of any such individual and the termination or expiration of this Agreement.

This clause 26 is in addition to, and does not relieve, remove or replace, a party's obligations under the Data Protection Legislation. 26.2. The CONTRACTOR shall, in relation to any Personal Data processed in connection with the performance by the CONTRACTOR of its obligations under the PURCHASE ORDER: (a) process that Personal Data only to the extent, and in such manner, as is necessary for the purposes specified in the PURCHASE ORDER and in accordance with the written instructions of the COMPANY; (b) ensure that it has in place appropriate technical and organisational measures, to protect against unauthorised or unlawful processing of Personal Data and against accidental loss or destruction of, or damage to, Personal Data, appropriate to the harm that might result from the unauthorised or unlawful processing or accidental loss, destruction or damage and the nature of the data to be protected, having regard to the state of technological development and the cost of implementing any measures (those measures may include, where appropriate, pseudonymising and encrypting Personal Data, ensuring confidentiality, integrity, availability and resilience of its systems and services, ensuring that availability of and access to Personal Data can be restored in a timely manner after an incident, and regularly assessing and evaluating the effectiveness of the technical and organisation al measures adopted by it); ensure that access to Personal Data is limited to personnel who need to access the Personal Data to ensure the CONTRACTOR’s obligations under the PURCHASE ORDER and that all personnel who have access to and/or process Personal Data are obliged to keep the Personal Data confidential; (c) not transfer any Personal Data hosted from within the European Economic Area (EEA) outside of the EEA unless the prior writt en consent of the COMPANY has been obtained and the following conditions are fulfilled: i. the COMPANY or the CONTRACTOR has provided appropriate safeguards in relation to the transfer; ii. the data subject has enforceable rights and effective legal remedies; iii. the CONTRACTOR complies with its obligations under the Data Protection Legislation by providing an adequate level of protection to any Personal Data that is transferred; and iv. the CONTRACTOR complies with reasonable instructions notified to it in advance by the COMPANY with respect to the proc...
