Common use of Personal Injuries, Property Damage and Motor Vehicle Accident Clause in Contracts

Personal Injuries, Property Damage and Motor Vehicle Accident. Owner agrees to hold harmless Contractor; subcontractors; suppliers; any employee or contractor to NCORR, Commerce or other State agency; or any third-party for claims of damages for arising from or related to personal injuries, property damage, damage to motor vehicles, wrongful death, and such other tort claim caused by Owner at the Project site during Construction (including inspections). Owner shall make sure it has insurance coverage in place prior and during construction in case there is an event or occurrence resulting from Owner’s failure to properly secure any pet or firearm. If Owner fails to obtain suitable insurance or allows the policy to be cancelled because nonpayment or failure to renew, then NCORR may exercise its discretion to obtain such insurance on behalf of Owner and/or authorize Contractor to purchase additional insurance coverage for these potential liabilities resulting in a change order (if due to an unforeseen Owner hardship) or a deductive change order to remove noncritical work (i.e., work that will not prevent issuance of a certificate of occupancy and/or will not create any issue of life safety) to compensate for NCORR’s payment of insurance premiums (if the lack of insurance was caused by lack of Owner diligence or was intentional).
