Phase B a. The wage in phase B is determined on commencement of the secondment agreement, in accordance with article 18 of this Collective Labour Agreement.
b. The actual wage in a new placement under the same secondment agreement in phase B is at least equal to the actual wage earned before the cessation of agency work.
c. The actual wage under a new secondment agreement in phase B is at least equal to the reversion wage, unless there has been an interruption of thirteen weeks or longer, but less than 26 weeks, between two agency work employment contracts.
Phase B. Monsanto Canada may terminate this Agreement upon delivery by Monsanto Canada to Protiva of (i) written notice of termination at any time during Phase B and (ii) [***] by electronic wire as arranged with Protiva. Notwithstanding the foregoing, if Phase C is initiated by Monsanto Canada, Monsanto Canada shall not be entitled to terminate this Agreement pursuant to this Section 9(e).

Phase B. For each fiscal quarter ending after December 15, 2012 (each such quarter, an “Applicable Quarter”), the following financial covenants will be measured as follows:
Phase B. 1.4.1 SPACECRAFT BUS CONFIRMATION REVIEW SpaceDev shall support the Confirmation Review by providing date that: (i) Demonstrates that the spacecraft bus preliminary design meets all mission and system requirements with acceptable risk; (ii) Exhibits that acceptable spacecraft bus design options have been selected, subsystem-to-subsystem interfaces are defined in detail, and verification methodologies associated with each operational, functional, interface, and performance requirement have been satisfactorily described; (iii) Provides the engineering basis for design approaches; (iv) Demonstrates that mission requirements are well understood and the mission design is adequate to meet mission requirements; (v) Management and system engineering processes are sufficient to develop and operate the mission, and (vi) Schedules and control processes demonstrate that the mission will remain within the Firm Fixed Price of the contract.
1.4.2 PROCUREMENT SpaceDev shall initiate the procurement of critical, long-lead parts, and components as required to meet schedule requirements established by University.
Phase B a. Temporary agency workers work in phase B once the agency work employment contract is continued after phase A or if a new agency work employment contract is concluded within six months of the completion of phase A with the same private employment agency.
b. Phase B lasts for a maximum of four years. Temporary agency workers do not work in phase C (see paragraph 3 of this article below) if they have not worked more than four years in phase B and/or no more than six secondment agreements for a fixed period have been con- cluded with the same private employment agency in phase B.
c. In phase B, temporary agency workers always work on the basis of a secondment agreement for a fixed period, unless a secondment agreement is expressly concluded for an indefinite period.
d. The four year period and the six secondment agreements (as referred to under b.) continue to be counted for as long as there is no interruption of more than six months between two secondment agreements. In that case, the interruption is counted. If there is an interruption between two secondment agreements of more than six months, the counting of phase A starts again.
e. Pursuant to Section 7:668a(9) of the Netherlands Civil Code, and by way of derogation from the provisions of b. of this paragraph, a secondment agreement that is concluded exclusively and predominantly for the training of the temporary agency worker is no longer included in the count of six secondment agreements and/or the four-year period, to the extent that this is necessary in order to complete the training. Temporary agency workers who are receiving training for BKA (occupational qualification as assistant) level 1 are subject to the condition that this BKA course is included on the list of STOOF as provided in article 27(1) under bullet point 6. The working conditions applying for temporary agency workers in phase B remain in effect in full. The count for pension purposes also continues.
f. Pursuant to Section 7:668a(10) of the Netherlands Civil Code, and by way of derogation from the provisions of b. of this paragraph, a secondment agreement that is concluded in connec- tion with BBL (Dual system), within the meaning of Article 7.2.2. of the Vocational Training Act, is not included in the count of six secondment agreements and/or the period of four years. Phase B. Section 4.1. Term and Contingency ------------------------------------- The term of Phase B begins on the last day of Phase A through to the end of the term defined in Section 8.01 of the Lilly License. Entrance into Phase B is contingent on ADOLOR delivering to XXXXXXX during the term of Phase A notice of ADOLOR's intent to proceed with Phase B.
Section 4.2. Phase B Consideration -------------------------------------- Subject to the foregoing, in consideration for Phase B, ADOLOR shall pay XXXXXXX: . $300,000 payable within five (5) business days of the expiration of Phase A; . $** payable within five (5) business days of the filing of a first application for a NDA or similar filing in the United States, Canada, Japan or the European Community that seeks permission to market a Product; . $** payable within five (5) business days of receiving notice of acceptance of a first NDA or similar filing in the United States, Canada, Japan or the European Community that seeks permission to market a Product; and . a royalty equal to **% of Net Sales. ADOLOR shall pay Lilly, on behalf of XXXXXXX, $** upon acceptance of a first NDA or similar filing in the United States, Canada, Japan or the European Community that seeks permission to market a Product, in accordance with Section 3.01(v) the Lilly License. ADOLOR agrees to pay Lilly, on behalf of XXXXXXX, a royalty equal to ** % of Net Sales in accordance with the Lilly License. For any payment made on behalf of XXXXXXX, ADOLOR shall deliver proof of such payment to XXXXXXX. **=Certain information on this page has been omitted and filed separately with the Commission. Section 4.3. ADOLOR's Phase B Duties ----------------------------------------
(i) of the Lilly License. Except for costs associated with Robert's duties under this Agreement, all costs associated with developing and commercializing the Compound or Product shall be borne by ADOLOR.
Phase B. Phase B shall include 164 units, shall be 100% affordable and may include moderate-income households, excluding two property manager’s units, as further set forth in the Affordable Housing Assistance Agreement executed herewith. To ensure Phase B of the Project qualifies as a “Community Benefit” under the Specific Plan for use of Excess Capacity, Developer shall obtain the City Manager’s written approval of a final Phase B affordability level plan.
Phase B. Provided there is a Phase B hereunder, six thousand dollars ($6,000) per month for each month of Phase B during which AIP renders services as required herein, payable by the last day of each such month.
