Common use of Physical Plant Standards Clause in Contracts

Physical Plant Standards. To the best of Borrower's knowledge, the Facility and the use thereof comply in all material respects with all applicable local, state and federal building codes, fire codes, health care, nursing/assisted living/senior housing facility (as applicable) and other similar regulatory requirements (the "Physical Plant Standards"), and except as set forth on Schedule 3.11 attached hereto, no waivers of Physical Plant Standards exist at the Facility.
