Common use of Physical Plant Standards Clause in Contracts

Physical Plant Standards. To the best of Borrower's knowledge, each Facility and the use thereof complies in all material respects with all applicable local, state and federal building codes, fire codes, zoning codes, use restrictions, health care, health care facility and other similar regulatory requirements (the "Physical Plant Standards"), and no waivers of Physical Plant Standards exist at any Facility.

Physical Plant Standards. To the best of Borrower's knowledge, each the Facility and the use thereof complies comply in all material respects with all applicable local, state and federal building codes, fire codes, zoning codes, use restrictions, health care, health care nursing/assisted living/senior housing facility (as applicable) and other similar regulatory requirements (the "Physical Plant Standards"), and except as set forth on Schedule 3.11 attached hereto, no waivers of Physical Plant Standards exist at any the Facility.
