Common use of PIGGYBACKING Clause in Contracts

PIGGYBACKING. Idaho Code 67-2803(1) provides a Bidding exemption for state agencies and political subdivisions where the procurement duplicates the price and substance of a contract for like goods or services that have been competitively Bid by the State of Idaho or one of its political subdivisions. Bidders agree to make the prices, terms and conditions offered under this agreement available to other public agencies in the State of Idaho, as identified in Idaho Code 67-2337 during the period that this agreement is in effect. Upon mutual agreement between the Bidder and public agency, the prices offered to other public agencies shall be at the same rate as offered to Xxxx Xxx School District. WASD does not guarantee purchases from any other public agency. Any liability created by purchase orders issued against this agreement shall be the sole responsibility of the district or agency placing the order.
