Pipeline Construction. As of the Effective Date, subject to the terms of this Agreement, Carrier shall begin project design, permitting, engineering, and other work with respect to the Knight Warrior Pipeline and shall use commercially reasonable efforts to cause the Knight Warrior Pipeline to be Complete. Carrier will inform Shipper on a periodic basis of construction progress of the Knight Warrior Pipeline, the nature and extent of any delays, and plans to mitigate such delays.
Pipeline Construction. At least thirty (30) days prior to the date on which the EDNC Baytown Plant becomes Fully Operational, EDNC shall complete the construction of those pipelines that are necessary to transport: (i) Excess Steam and pipeline-borne Waste from the EDNC Baytown Plant to the appropriate Battery Limits tie-in points designated by mutual agreement of the parties, and (ii) all specified Utilities from the appropriate tie-in points at the Battery Limits designated by mutual agreement of the parties. Bayer shall design, engineer and construct the Delivery Systems in accordance with the provisions of Section 13.1 of the Project and Supply Agreement.
Pipeline Construction. Refer to the attached Exhibit B 2.11 for Company's general scope of work.
Pipeline Construction. 3.1 South Heart shall not alter the design of the SH Pipeline or the Pond Pipeline as currently installed and constructed.
3.2 ▇▇▇▇▇▇▇▇▇ is not responsible and will in no way be held liable, for any claim resulting from the construction, operation or maintenance of the Pond Pipeline constructed by South Heart.
