Handling. In order to protect such Confidential Information from improper disclosure, each Party agrees:
(a) That all Confidential Information shall be and shall remain the exclusive property of the source;
(b) To limit access to such Confidential Information to authorized employees who have a need to know the Confidential Information for performance of this Agreement;
(c) To keep such Confidential Information confidential and to use the same level of care to prevent disclosure or unauthorized use of the received Confidential Information as it exercises in protecting its own Confidential Information of a similar nature;
(d) Not to copy, publish, or disclose such Confidential Information to others or authorize anyone else to copy, publish, or disclose such Confidential Information to others without the prior written approval of the source;
(e) To return promptly any copies of such Confidential Information to the source at its request; and
(f) To use such Confidential Information only for purposes of fulfilling work or services performed hereunder and for other purposes only upon such terms as may be agreed upon between the Parties in writing.

(e) To promptly return any copies of such Confidential Information to the source at its request;
(f) To use such Confidential Information only for purposes of performing work or services described hereunder and for other purposes only upon such terms as may be agreed upon between the Parties in writing; and
(g) Subject to the exceptions in Section 14.3 below, if the Party receiving Confidential Information wishes to disclose the disclosing Party’s Confidential Information to a third-party, such disclosure must be agreed to in writing by the disclosing Party, and the third-party must have executed a written agreement of nondisclosure and nonuse comparable in scope to the terms of this Section.

4.2.5 Upon the source’s request, to return or destroy promptly any copies of such Confidential Information at its request; and
4.2.6 To use such Confidential Information only for purposes of fulfilling work or services performed hereunder and for other purposes only upon such terms as may be agreed upon between the Parties in writing.
Handling. In order to protect such Confidential Information from improper disclosure, each Party shall be fully responsible for any unauthorized use and disclosure of, and access to, the other Party’s Confidential Information and each Party agrees:
(a) That all Confidential Information shall be and shall remain the exclusive property of the Party from whom or from whose representative(s), the Confidential Information is obtained ("Source");
(b) To limit access to such Confidential Information to authorized employees who have a need to know the Confidential Information for performance of this Agreement;
(c) To employ administrative, physical, and technical safeguards that prevent such unauthorized access, disclosure, and use (“Safeguards”). Without limiting the foregoing, each Party shall at a minimum employ best industry practice to Safeguard the other Party’s Proprietary Information, whether “at rest” or in transport;;
(d) Not to publish or disclose such Confidential Information to others or authorize anyone else to publish or disclose such Confidential Information to others without the prior written approval of the Source;
(e) To return promptly any copies of such Confidential Information to the Source within sixty (60) days or at its request; and
(f) To use such Confidential Information only for purposes of fulfilling work or services performed hereunder and for other purposes only upon such terms as may be agreed upon between the Parties in writing.
Handling. Protective mask and gloves should be worn when handling “Stingy Sticks”
Handling. Equipment and materials received for installation on the Project(s) shall be handled in accordance with the manufacturer’s recommendations, and in a manner that will prevent damage. Equipment and materials shall be stored prior to installation as recommended by the manufacturer. Generally, materials such as pipe shall be stored off the ground in approved storage yards. Items subject to damage by the elements, vandalism, or theft shall be stored in secure buildings. Items requiring environmental control for protection shall be provided with the necessary environmentally controlled storage facilities at no cost to the City.
Handling. Developer shall provide methods of handling products that prevent damage or deterioration. Special handling clothing and precautions shall be identified for all hazardous materials, with assurances that only qualified and trained personnel handle the material. The handling procedures shall include instructions to follow for decontamination and the notification of authorities and responsible parties in the event of an accident.
Handling. The Manager shall use the same or greater effort to avoid unauthorized use or disclosure of Confidential Information as it employs with respect to its own confidential information.
