Common use of Placement of Purchase Orders Clause in Contracts

Placement of Purchase Orders. Prior to the commencement of every Fiscal Quarter, Intel shall place a non-cancelable blanket purchase order in writing (via e-mail or facsimile transmission) for each Probed Wafer to be supplied by the Joint Venture Company for the upcoming Fiscal Quarter during the Term (each such order, a “Purchase Order”), which Purchase Order shall request a quantity of Probed Wafers that is no less than the quantity set forth in the current Planning Forecast for such upcoming Fiscal Quarter.

Prior to the commencement of every Fiscal QuarterQuarter during the Term, Intel shall place a non-cancelable blanket purchase order in writing (via e-mail or facsimile transmission) for each Qualified Probed Wafer Wafers to be supplied shipped by the Joint Venture Company Micron for the upcoming Fiscal Quarter during the Term (each such order, a “Purchase Order”), which each such Purchase Order shall request a quantity of Qualified Probed Wafers that is no less than equals the quantity set forth in the current Planning Response to Forecast for such upcoming Fiscal Quarterperiod.
