Those portions of the Plan Disclosure Documents made in reliance upon and in conformity with information furnished to the Company by LGE in writing for use in connection with the preparation thereof will not, at the date mailed by the Company to the creditors and equity security holders of the Company, the date the Bankruptcy Court enters the Confirmation Order or the Closing Date, contain any untrue statement of material fact or omit to state any material fact required to be stated therein or necessary in order to make the statements therein, in light of the circumstances under which they are made, not misleading. The Company acknowledges that the portions of the Plan Disclosure Documents set forth in Section 5.4 of the LGE Disclosure Letter constitute the only information furnished in writing by LGE.
