Common use of Policies with Insureds in Addition to Maintenance Contractor Clause in Contracts

Policies with Insureds in Addition to Maintenance Contractor. All insurance policies that are required to insure Persons (whether as named or additional insureds) in addition to Maintenance Contractor shall comply or be endorsed to comply with the following provisions. 7.3.6.1 The insurance policy shall be written or endorsed so that no acts or omissions of an insured shall vitiate coverage of the other insureds. Without limiting the foregoing, any failure on the part of a named insured to comply with reporting provisions or other conditions of the insurance policies, any breach of warranty, any action or inaction of a named insured or others, or any change in ownership of all or any portion of the Project shall not affect coverage provided to the other named insureds or additional insureds (and their respective members, directors, officers, employees, agents and project consultants). 7.3.6.2 The insurance shall apply separately to each named insured and additional insured against whom a claim is made or suit is brought, except with respect to the limits of the insurer’s liability. 7.3.6.3 All endorsements adding additional insureds to required insurance policies, shall contain no limitations, conditions, restrictions or exceptions to coverage in addition to those that apply under the insurance policy generally, and shall state that the interests and protections of each additional insured shall not be affected by any misrepresentation, act or omission of a named insured or any breach by a named insured of any provision in the policy which would otherwise result in forfeiture or reduction of coverage.
