Common use of Possession of the Premises Clause in Contracts

Possession of the Premises. A. TENANT shall not be entitled to possession of the Property until the security deposit and first month’s rent (or pro-­‐rated portion thereof for a partial month) are paid in full and the Property has been vacated by the prior occupant. B. TENANT expressly agrees and acknowledges that if by reason of the Property being unready for occupancy, the prior occupant not vacating the premises in a timely fashion or any other cause whatsoever, the TENANT shall be unable to enter and occupy the Property. C. TENANT expressly agrees and acknowledges that the LANDLORD shall not be liable to the TENANT for damages for the inability of the TENANT to enter and occupy the Property as specified in this section. The LANDLORD shall xxxxx the rent and other charges and fees required under this Lease for the period in which the TENANT is unable to enter and occupy the Property.
