Common use of Potential Claimants Clause in Contracts

Potential Claimants. Each member of the Settlement Class who does not timely and validly request exclusion from the Settlement as required in this Agreement will be a Settlement Class Member and entitled to make a claim. Each Settlement Class Member will be entitled to make a single claim for one call regardless of the number of accounts the Settlement Class Member had, the number of times the Settlement Class Member was called, or the number of cellular numbers at which the Settlement Class Member was called.

Potential Claimants. Each member of the Settlement Class who does not timely and validly request exclusion from the Settlement as required in this Agreement will shall be a Settlement Class Member and entitled to make a claim. Each Settlement Class Member will shall be entitled to make a single one claim for one call regardless of the number of accounts the Settlement Class Member had, the number of times the Settlement Class Member was called, or except to the number of cellular numbers at which the extent a Settlement Class Member was calledreceived Calls qualifying under Subclass One and Subclass Two, as discussed in Section 4.03, above, in which case that Settlement Class Member shall be entitled to make one claim for each subclass to which he or she belongs.

Each member of the Settlement Class Member who does not timely and validly request exclusion from the Settlement as required in this Agreement will shall be a Settlement Class Member and entitled to make submit a claimClaim Form. Each Settlement Class Member will shall be entitled to make a single only one claim for one call regardless of the per cellular telephone number of accounts the Settlement Class Member had, the number of times the Settlement Class Member was called, or the number of cellular numbers at which the Settlement Class Member was calledthat received text messages.

The calculation of the Cash Award will be based on a per-Call, or the number of cellular numbers at which the Settlement Class Member was calledpro rata basis, as discussed herein.

Each Settlement Class Member will shall be entitled to make a single claim for only one call claim, except those Settlement Class Members who already have settlement agreements with I.C. System and/or any of its clients, regardless of the number of accounts the that Settlement Class Member had, the number of times the Settlement Class Member was calledhad or has with I.C. System, or the number of cellular numbers at which the calls made to that Settlement Class Member was calledMember's cell phone number(s).

Each Settlement Class Member will shall be entitled to make a single one claim for one call per unique cell phone number on which they received Texts, regardless of the number of accounts the Settlement Class Member had, the number of times the Settlement Class Member was called, texted on a particular cell number. Though a single claim (or the number of cellular multiple if different unique cell numbers at which the to a Settlement Class Member was calledMember), the calculation of the claim will be based on a per-Text, pro rata basis, as discussed herein.
