Payment to Class Representatives. The Class Representatives will ask the Court to award them incentive payments for the time and effort they have personally invested in the Litigation. Defendants will not object to such incentive payments to be paid to Xxxx, Amadeck, Kalik, Patterson, and Xxxxxxx from the Settlement Fund provided they do not exceed $25,000 in the aggregate (or $5,000 for each Class Representative), subject to Court approval. Payment to Class Representatives. All payments required to be made under this Section 8 shall be made, with respect to each Class of Secured Parties, to the Project Credit Party acting on behalf of such Class. Each such Project Credit Party shall apply such funds in accordance with its respective Facility Agreement.
Payment to Class Representatives. Plaintiffs/Class Representatives will move the Court for an incentive award to the Class Representatives for the time and effort they have personally invested in the Action. Plaintiff/Class Representative Xxxx agrees that her request for an incentive award shall not exceed $7,500. Defendant shall not object to any request by Plaintiffs/Class Representatives for an incentive award that is consistent with this Section. The amount of any incentive award approved by the Court shall be paid, separate from, and in addition to the amounts paid to the Settlement Class. Payment of incentive awards should be made consistent with section 6.01.
Payment to Class Representatives. The Class Representatives will ask the Court to award them a payment for the time, effort, expense, and service that they personally invested in the Litigation. Defendants will not object to such payment to be paid to the Class Representatives from the Settlement Fund provided that the payment does not exceed $10,000 per Class Representative, subject to Court approval. Class Counsel will file the motion for service awards and post the motion and all supporting papers on the Settlement Website no later than fourteen (14) days before the Claims Deadline, Objection Deadline, and Exclusion Deadline.
Payment to Class Representatives. Plaintiff/Class Representative will also ask the Court to award them incentive payments for the time and effort they have personally invested in this Action. Defendant shall not object to such incentive payment provided it does not exceed $5,000.00, subject to Court approval. Within five (5) days of the Funding Date and after receipt of payees' completed W-9 forms, the Claims Administrator shall pay to Plaintiff’s counsel the amount of incentive payments awarded by the Court, and Plaintiff’s counsel shall disburse such funds.
Payment to Class Representatives. In recognition of the significant time and effort Class Representatives have personally invested in the Action, including but not limited to consulting with Class Counsel, participating in initial discovery, and providing information and input necessary for the prosecution of this case, which efforts have provided a benefit to the Class and California Subclass, each Class Representative will be entitled to apply to the Court for a Service Award and Defendants will not object to a Service Award to be paid to Class Representatives from the Settlement Fund, provided that it does not exceed $1,000, subject to Court approval. Within three (3) business days of the Effective Date, and after receiving W-9 forms from the Class Representatives, the Claims Administrator shall pay to Class Counsel the amount of any service payments awarded by the Court out of the Settlement Fund, and Class Counsel will disburse such funds. No interest will accrue on such amounts at any time. The Parties warrant that they commenced negotiations on the proposed Service Award (along with the Attorneys’ Xxxx and Costs discussed in Section 6.01) only after they reached agreement on all other material terms of this Settlement Agreement.
Payment to Class Representatives. Class Representatives will also ask the Court to award them incentive payments for the time and effort they have personally invested in this Action. Defendants shall not object to such incentive payments to be paid to all three named Class Representatives from the Cash Component of the Settlement Fund provided they do not exceed $7,500 in the aggregate, $2,500 for each Class Representative, subject to Court approval. Within ten (10) business days of receipt of the $2,000,000 referenced in Section 5.02 above, and after receipt of payees' completed W-9 forms, the Claims Administrator shall pay to Class Counsel the amount of incentive payments awarded by the Court, and Class Counsel shall disburse such funds to each Class Representative.
Payment to Class Representatives. In recognition of the significant time and effort they have personally invested in the Action, including but not limited to consulting with Class Counsel, participating in discovery, providing information and input necessary for the prosecution of this case, and preparing for a contested motion for class certification, which efforts have provided a benefit to the Settlement Class, Plaintiffs shall be entitled to apply to the Court for an incentive payment. Within five (5) business days of the Funding Date, and after receiving W-9 forms from the Class Representatives, the Claims Administrator shall pay to Class Counsel the amount of any incentive payment awarded by the Court out of the Settlement Fund, and Class Counsel shall disburse such funds. No interest will accrue on such amounts at any time.
Payment to Class Representatives. Life Time agrees to pay service awards to the Class Representatives in the amount awarded by the Court. The Class Representatives will ask the Court to award them service awards for the time and effort they have personally invested in the Action in the amount of $5,000.00 each. Life Time will pay the awarded amounts within 14 days after the Effective Date, provided it has received current W-9 forms and payment instructions from Class Counsel and the Class Representatives by the Effective Date.
Payment to Class Representatives. Plaintiff/Class Representative will also ask the Court to award him an incentive/service payment for the time and effort he has personally invested in this Action. Defendants shall not object to such incentive/service payment to be paid to Class Representative separate and apart from the Settlement Benefit provided such request does not exceed Five Thousand Dollars ($5,000.00). Within ten (10) business days of the Effective Date and after receipt of payees’ completed W-9 forms, the Claims Administrator shall pay to Plaintiff’s Counsel the amount of the incentive/service payment awarded by the Court, and Plaintiff’s Counsel shall disburse such funds. Payment of such an incentive/service award will not reduce any settlement benefits received by any claiming Class Member.
