Common use of Pre-Approved Wireless Installations Clause in Contracts

Pre-Approved Wireless Installations. Once a Wireless Installation design has become a Pre-Approved Wireless Installation for Licensee’s use of a Structure and/or Infrastructure, then Licensee shall be allowed to install a Wireless Installation using any such Pre-Approved Wireless Installation without further land use review or approval by Licensor, subject to space and structural capacity and loading review by Licensor during the building permit review process. All other municipal reviews and approvals, including the execution of a Site License Agreement, building permits and right of way permits, shall apply to the installation of any Pre-Approved Wireless Installation.

Once a Wireless Installation design has become a Pre-Approved Wireless Installation for Licensee’s use of a Structure and/or Infrastructure, then Licensee shall be allowed to install a Wireless Installation using any such Pre-Approved Wireless Installation without further land use review or approval by Licensor; provided, however, Licensee’s use of a Licensor Structure and/or Infrastructure shall be subject to space and structural capacity and loading review by Licensor during the building permit review process. All other municipal reviews and approvals, including the execution of a Site License Agreement, building permits and right of way permits, shall apply to the installation of any Pre-Approved Wireless Installation.

Once a Wireless Installation design has become a Pre-Approved Wireless Installation for Licensee’s use of a Structure and/or Infrastructure, then Licensee shall be allowed to install a Wireless Installation using any such Pre-Approved Wireless Installation without further land use review or approval by LicensorInstallation, subject to space and structural capacity and loading review by Licensor City during the building permit review process. All other municipal reviews and approvals, including the execution issuance of a Site License Agreement, building and any associated permits and right of way permitsor approvals for Wireless Installations as specified by City, shall apply to the installation of any Pre-Pre- Approved Wireless Installation. In the event that Licensee substantively modifies the design of the Wireless Installation, Licensee will be required to obtain pre-approval for the design.
