Common use of Pre-existing Rights Clause in Contracts

Pre-existing Rights. In no case shall Sections 6.01 and 6.02 apply to, or prevent the Contractor from asserting or protecting its rights in any discovery, invention, report, document, data, photograph, deliverable, or other material in connection with or produced pursuant to this Agreement that existed prior to or was developed or discovered independently from the activities directly related to this Agreement.

Pre-existing Rights. In no case shall Sections 6.01 and 6.02 4(a) or 4(b) above apply to, or prevent the Contractor from asserting or protecting its rights in any discovery, invention, report, document, document or other data, photograph, deliverable, or other material in connection with or produced pursuant to this Agreement that any invention which existed prior to or was developed or discovered independently from the activities directly related to this Agreement.

In no case shall Sections H 6.01 and H 6.02 apply to, or prevent the Contractor from asserting or protecting its rights in any discovery, invention, report, document, data, photograph, deliverable, or other material in connection with or produced pursuant to this Agreement that existed prior to or was developed or discovered independently from the activities directly related to this Agreement.
