Common use of Pre-Litigation Discussion Clause in Contracts

Pre-Litigation Discussion. The Parties will cause the individuals identified in their respective notices under Section 9.2 above to promptly make such investigation of the dispute as such individuals deem appropriate. Promptly and in no event later than ten (10) days after the date of the initiating Party's notice under Section 9.2, such individuals will commence discussions concerning resolution of the dispute. If the dispute has not been resolved within thirty (30) days after commencement of such discussions, then any Party may request that the other Parties make their presidents available to discuss resolution of such dispute. Each Party will cause its president to meet together to discuss such dispute at a mutually agreed upon time within fifteen (15) days after a Party makes such request. If the dispute has not been resolved within thirty (30) days after the presidents of the Parties have first met, any Party may submit the dispute to litigation.
