Common use of Predominant Task Order NAICS Determination Clause in Contracts

Predominant Task Order NAICS Determination. The OCO has the responsibility to determine which predominant NAICS code applies to a task order solicitation, whether or not the task order is unrestricted or set-aside, including the type of socio-economic set-aside if applicable, and whether or not the solicitation is sole-source or competitive. Under this unrestricted contract, a task order cannot be a set-aside or a socio- economic set-aside. If the solicitation could be classified in two or more NAICS codes with the same or different size standard, the OCO shall only apply the Pool 4 NAICS code and corresponding size standard for the industry accounting for the greatest percentage of anticipated task order price/cost. Under this contract, the OCO must identify a predominate Pool 4 NAICS Code and 1,000 Employee Business Size Standard from the table below in the task order solicitation and report the NAICS Code in the Federal Procurement Data System (FPDS). The OCO must provide fair opportunity to all Contractors under Pool 4 for solicitation purposes, unless an exception to fair opportunity under Pool 4 has been properly executed.
