Common use of Preliminary Approval Order Clause in Contracts

Preliminary Approval Order. “Preliminary Approval Order” means the order entered and filed by the Court that preliminarily approves the terms and conditions of this Agreement, including without limitation the manner and content of providing notice to the Class.

Preliminary Approval Order. “Preliminary Approval Order” " means an executed version of the order Proposed Preliminary Approval Order attached hereto as Exhibit A, or a version substantially the same in material respects, to be entered and filed by the Court that preliminarily approves granting, among other things, preliminary approval of the terms Agreement. Further revisions, if any, to Exhibit A are subject to final approval by the Parties and conditions of this Agreementthe Court, including without limitation the manner and content of providing notice to the Classif necessary.

Preliminary Approval Order. “Preliminary Approval Order” means the order Order entered and filed by the Court that Court: Class; (i) preliminarily approves approving the terms and conditions of this Agreement, including without limitation ; (ii) directing the manner and content timing of providing notice Notice to the Class.Class Members; and (iii) setting the dates and deadlines for effectuating settlement, including the Bar Date, date of the publication of Notice, and the Fairness Hearing date. The Proposed Preliminary Approval Order is annexed to the Ambinder Decl. as Exhibit “D.”

Preliminary Approval Order. “Preliminary Approval Order” means an Order consistent with Paragraph 8, preliminarily approving the order entered Settlement and filed by modifying the Court that preliminarily approves the terms and conditions of this Agreement, including without limitation the manner and content of providing notice to class definition in the Class-Certification Order for purposes of the settlement, directing the issuance of class notice, and scheduling a settlement hearing under Missouri Supreme Court Rule 52.08.

As used herein, the terms “Preliminary Approval Order” means the order entered provisionally certifying the Class for settlement purposes only, approving and filed by directing notice, and setting the Fairness Hearing. The proposed Preliminary Approval Order that Plaintiff submits to the Court that preliminarily approves the terms and conditions of this Agreement, including without limitation the manner and content of providing notice for its approval must be substantially similar to the Class.form attached as Exhibit A.
