Preliminary Findings. Upon comple- tion of an inspection, the Inspection Team will meet with the Host Team and facility personnel to review the written preliminary findings of the In- spection Team and to clarify ambigu- ities. The Host Team will discuss the preliminary findings with the facility, and the Host Team Leader will take into consideration the facility’s input when providing official comments on the preliminary findings to the Inspec- tion Team. (a) Inspection notification—(1)(i) Con- tent of notice. Inspections of facilities may be made only upon issuance of written notice by the United States National Authority (USNA) to the owner and to the operator, occupant or agent in charge of the premises to be inspected. BIS will also provide a sepa- rate inspection notification to the in- spection point of contact identified in declarations submitted by the facility. If the United States is unable to pro- vide actual written notice to the owner and to the operator, occupant or agent in charge, BIS (or the Federal Bureau of Investigation, if BIS is unable) may post notice prominently at the facility to be inspected. The notice shall in- clude all appropriate information pro- vided by the OPCW to the USNA con- cerning:
(A) The type of inspection;
(B) The basis for the selection of the facility or location for the type of in- spection sought;
(C) The time and date that the in- spection will begin and the period cov- ered by the inspection; and
Preliminary Findings. There will be timely interim discussions of preliminary findings with the goal of reaching agreement on each potential issue at the earliest point in the review. An exit meeting will be held for each site reviewed. The primary purpose of these meetings is to verify facts related to the audits or attestation engagements or other documentation. At the completion of the fieldwork, the review team will hold an exit briefing. The purpose of this exit briefing is to discuss the preliminary results of the peer review, the opinion to be expressed, and any areas of noncompliance.

On behalf of Buyer in connection with Buyer's due diligence relating to Buyer's purchase of the Assets, SHN has identified the presence of acetone, ethyl benzene, freon 113 and two isomers of xylene (the "four chemicals") in shallow soil and/or shallow groundwater at the easterly area of the Property, based on SHN's sampling at that location during December 1997. However, owing to the preliminary nature of SHN's investigation and the limited data SHN has acquired to date, SHN has indicated it has not been able to reach reliable conclusions regarding the source of the Release of the four chemicals, the direction of groundwater movement beneath the Property or whether such chemicals might be found in other concentrations and locations beneath or adjacent to the Property as a result of Releases, if any, originating at the Property. The purpose of this Section 5.9 is to set forth an action plan intended to resolve those uncertainties and to take remedial action if and to the extent appropriate under applicable law.

When the situation arises, the Investigating Officer will convene separate meetings with the parties involved to discuss preliminary findings of the investigation and inform participants of the possibility and nature of the resolution and the reasons. The stage allows for all parties to become aware and agree with the tentative findings and presents the opportunity, based on the information, to resolve the matter without further complications. Where agreement is reached and the matter deemed resolved, the Investigating Officer will document the outcome in a summary report. The report can, with the written consent of the complainant, be made available to identified participants upon request.
