Preservation of Legal Privilege. If DIR notifies Successful Respondent, or Successful Respondent is otherwise aware, that particular DIR Confidential Information may be within DIR attorney-client or work-work- product privileges of DIR, then regardless of any applicable exclusions, Successful Respondent shall:(i) shall not disclose such DIR Confidential Information or take any other action that would result in waiver of such privileges and (ii) shall instruct all Successful Respondent Personnel who may have access to such communications to maintain privileged material as strictly confidential and otherwise protect DIR privileges.
