Pressure. Shipper shall Tender or cause to be Tendered Gas and Joint Dedicated Liquid Condensate to each applicable Receipt Point at sufficient pressure to enter the Gathering System against its operating pressure, but not in excess of the maximum operating pressure set forth in the design documents for the applicable Facility Segment contained in the applicable, approved Gathering System Plan (which such maximum operating pressure shall be sufficient to permit such Gas and Joint Dedicated Liquid Condensate to enter the Gathering System and the facilities of the Processing Plants, Downstream Pipelines or Downstream Condensate Storage Tanks (as applicable) but not higher than the MAOP of the Downstream Pipelines or other facilities). Shipper shall have the obligation to ensure that Gas and Joint Dedicated Liquid Condensate is prevented from entering the Gathering System at pressures in excess of such maximum operating pressure, and Gatherer shall have the right to restrict or relieve the flow of Gas and Joint Dedicated Liquid Condensate into the Gathering System to protect the Gathering System from over pressuring. Gatherer shall not change such maximum operating pressures without prior written notification to Shipper. Gatherer shall install, own, operate and maintain compression facilities sufficient to deliver Shipper’s owned and Controlled Gas and Joint Dedicated Liquid Condensate into the applicable Delivery Points. Re-deliveries of Gas and Joint Dedicated Liquid Condensate by Gatherer to or for the account of Shipper at the applicable Delivery Points shall be at such pressures as may exist from time to time in the Gathering System at the applicable Delivery Point. Gatherer’s obligation to re-deliver Gas and Joint Dedicated Liquid Condensate to a given Delivery Point shall be subject to the operational limitations of the Processing Plant or Downstream Pipelines (as applicable) receiving such Gas or Joint Dedicated Liquid Condensate (as applicable), including the Processing Plant’s or Downstream Pipeline’s capacity, Gas measurement capability, operating pressures and any operational balancing agreements as may be applicable.

Pressure. Shipper Section 3.1 Producer shall Tender deliver, or cause to be Tendered delivered, to Gatherer at the Points of Receipt, the Gas to be gathered hereunder at the pressures existing in the System as such pressure may exist from time to time, not to exceed the Maximum Pipeline Pressure and, if applicable, the Maximum CRP Pressure. Producer shall install, operate and Joint Dedicated Liquid Condensate maintain, at its sole expense, such pressure regulating devices as may be necessary to each applicable Receipt Point at sufficient regulate the pressure of Gas prior to enter deliver to Gatherer so as not to exceed the Gathering System against its operating Maximum Pipeline Pressure and, if applicable, the Maximum CRP Pressure. If Producer fails to regulate such pressure, but then the Gatherer may shut in such Gas until Producer has installed such regulating device. Section 3.2 Gatherer will deliver Gas at the Points of Delivery at the pressures required by the receiving pipeline at each such point, not in excess of to exceed the maximum allowable operating pressure set forth of TET, DTI, or TCO. If necessary, Gatherer shall provide sufficient compression to attempt to insure that the pressures existing on the System do not exceed the Maximum Pipeline Pressure and, if applicable, the Maximum CRP Pressure. Section 3.3 If Producer’s delivery of Gas volumes are restricted by Gatherer’s operating pressures exceeding the Maximum Pipeline Pressure or, if operating pressure should exceed if applicable, the Maximum CRP Pressure for thirty (30) Days in the design documents for the applicable Facility Segment contained in the applicableaggregate during any consecutive three-month period at a Point of Receipt, approved Gathering System Plan (which such maximum operating pressure shall be sufficient to permit such Gas and Joint Dedicated Liquid Condensate to enter the Gathering System and the facilities excluding events of the Processing PlantsForce Majeure, Downstream Pipelines or Downstream Condensate Storage Tanks (as applicable) but not higher than the MAOP of the Downstream Pipelines or other facilities). Shipper shall have the obligation to ensure that Gas and Joint Dedicated Liquid Condensate is prevented from entering the Gathering System at pressures in excess of such maximum operating pressure, and Gatherer Producer shall have the right to restrict or relieve notify Gatherer in writing of such occurrence (“Pressure Notice”) within ninety (90) Days of such occurrence. Upon receipt of Producer’s Pressure Notice, Gatherer will proceed to promptly address any operational issues to again provide Producer with pressures not to exceed the flow of Gas and Joint Dedicated Liquid Condensate into Maximum Pipeline Pressure and, if applicable, the Gathering System to protect the Gathering System from over pressuringMaximum CRP Pressure. Gatherer shall not change such maximum operating pressures without prior written notification to Shipper. Gatherer shall install, own, operate and maintain compression facilities sufficient to deliver Shipper’s owned and Controlled Gas and Joint Dedicated Liquid Condensate into the applicable Delivery Points. Re-deliveries of Gas and Joint Dedicated Liquid Condensate by Gatherer to or for the account of Shipper at the applicable Delivery Points shall be at such pressures as may exist from time to time in the Gathering System at the applicable Delivery Point. Gatherer’s This obligation to re-deliver Gas and Joint Dedicated Liquid Condensate to a given Delivery Point shall be subject to the operational limitations provisions of Section 4.1 of this Agreement. Section 3.4 If Gatherer’s only curative measure to maintain the Processing Plant Maximum Pipeline Pressure or Downstream Pipelines the Maximum CRP Pressure requires Gatherer to install additional compression and/or install additional pipelines, Gatherer may provide Producer written notice, within the twenty (20) Day period following Producer’s Pressure Notice, of Gatherer’s good faith intention to install such additional compression or pipelines and the target In-Service Date, which will be no later than twelve (12) months from the Pressure Notice, for such additional facilities, unless caused by Excusable Delay. Gatherer shall proceed without unreasonable delay and will install such facilities as applicable) receiving such Gas or Joint Dedicated Liquid Condensate (expeditiously as applicable), including reasonably possible. This obligation shall be subject to the Processing Plant’s or Downstream Pipeline’s capacity, Gas measurement capability, operating pressures and any operational balancing agreements as may be applicableprovisions of Section 4.1 of this Agreement.

Pressure. Shipper 6.1 The pressure at which Producer shall Tender deliver, or cause to be Tendered Gas and Joint Dedicated Liquid Condensate to delivered, gas at each applicable Receipt Point at of Delivery shall be sufficient pressure to enter Gatherer’s pipeline at each such Point of Delivery from time to time; provided, however, Gatherer’s pressure at the Gathering System against its operating pressurePoint(s) of Delivery shall not exceed 400 psig. 6.2 If any of Producer’s wxxxx become incapable of delivering gas into Gatherer’s pipeline, neither party shall have an obligation to compress, but each party shall have the option to do so. If Gatherer elects not to compress within a reasonable time after the need for compression appears, Producer may, by written notice to Gatherer, request that Gatherer either provide compression or release the affected gas sources as to the then-producing formations from commitment under this Agreement. If Producer requests that Gatherer provide compression, Gatherer shall promptly arrange for providing compression and upon installation of the necessary compression equipment the price to be paid by Gatherer for Producer’s gas shall be increased by a mutually agreeable compression fee that will allow Gatherer to recover its related fuel costs and reasonably compensate Gatherer for such additional costs and services. 6.3 Producer will furnish and cause to be installed at Producer’s expense, in accordance with customary industry standards, over-pressure protection devices which will control the pressure of gas being delivered to a pressure not in excess of the maximum operating pressure set forth in the design documents 500 psig. Gatherer shall not be responsible for the applicable Facility Segment contained in the applicable, approved Gathering System Plan (which such maximum operating pressure shall be sufficient to permit such Gas and Joint Dedicated Liquid Condensate to enter the Gathering System and the facilities any gas lost as a result of the Processing Plants, Downstream Pipelines or Downstream Condensate Storage Tanks (as applicable) but not higher than the MAOP failure of the Downstream Pipelines or other facilities). Shipper shall have operation of any such pressure devices. 6.4 If Gatherer’s pressure exceeds 400 psig at the obligation to ensure that Gas and Joint Dedicated Liquid Condensate is prevented from entering the Gathering System at pressures in excess Point of such maximum operating pressureDelivery, Producer may give Gatherer written notice of Gatherer’s breach of this Agreement and Gatherer shall have the right ninety (90) days after receipt of any such notice to restrict or relieve the flow of Gas and Joint Dedicated Liquid Condensate into the Gathering System to protect the Gathering System from over pressuring. Gatherer shall not change such maximum operating pressures without prior written notification to Shipper. Gatherer shall installtake, own, operate and maintain compression facilities sufficient to deliver Shipper’s owned and Controlled Gas and Joint Dedicated Liquid Condensate into the applicable Delivery Points. Re-deliveries of Gas and Joint Dedicated Liquid Condensate by Gatherer to or for the account of Shipper at the applicable Delivery Points shall be at such pressures as may exist from time to time in the Gathering System at the applicable Delivery Point. Gatherer’s obligation to re-deliver Gas and Joint Dedicated Liquid Condensate to a given Delivery Point shall be subject to the operational limitations of the Processing Plant or Downstream Pipelines (as applicable) receiving expense, such Gas or Joint Dedicated Liquid Condensate (as applicable), including the Processing Plant’s or Downstream Pipeline’s capacity, Gas measurement capability, operating pressures and any operational balancing agreements actions as may be applicablenecessary to cure any such breach of this Agreement. If Gatherer does not cure such breach within the time provided for in this Paragraph 6.4, upon Gatherer’s receipt of written notice from Producer withdrawing such Point of Delivery and the associated gas, such Point of Delivery and associated gas shall automatically, and without any further action on the part of Producer or Gatherer, be released from the terms of this Agreement without further obligation or liability of Producer of any kind with respect to such Point of Delivery and associated gas.
