Common use of Pricing the Variation Clause in Contracts

Pricing the Variation. (a) The Parties must negotiate in good faith to agree on the price for a Variation based on the prices listed upon the Order (and where no such prices are listed using reasonable market rate prices at the time of the Variation). If Owner and Xxxxx do not agree on the price for a Variation, Owner has the right to impose on Hirer a fair and reasonable price for that Variation.
