Common use of Prior Environmental Impacts Clause in Contracts

Prior Environmental Impacts. Nothing in this Article will be construed to make Company liable in any way for any environmental impacts or release of Hazardous Substances, as defined herein, affecting the Premises that occurred prior to Company’s entry upon or occupancy of the Premises by Company or that occurred as a result of the actions of Authority or any of its employees, agents, or contractors. Company and Authority acknowledge and agree that Exhibit B, Environmental Baseline Report, dated June 26, 2015, attached hereto and by this reference made a part hereof, states the condition of the Premises on the Effective Date of this Agreement, and the statements contained therein are acknowledged by the Parties.
