Prior Infestation Sample Clauses
The Prior Infestation clause defines the parties' responsibilities and liabilities regarding pest infestations that existed before the start of a lease or property transfer. Typically, this clause requires the seller or landlord to disclose any known pest problems, such as termites or rodents, that were present prior to the new occupant taking possession. It may also specify who is responsible for remediation costs if an infestation is discovered after the agreement begins. The core function of this clause is to allocate risk and ensure transparency, protecting the new occupant from unexpected expenses and disputes related to pre-existing pest issues.
