PRIOR OCCURRENCES. CONTRACTOR shall not be responsible for any losses or costs resulting from inmate litigation pending at the effective date of this Contract or for lawsuits based on acts or omissions occurring prior to the effective date of the Contract. CONTRACTOR agrees to cooperate with the State in the defense of these suits. The Bureau recognizes that any settlement or judgment in such cases may lead to a request that the compensation be increased pursuant to Section 7.3.
