Common use of Prior Plans Clause in Contracts

Prior Plans. Prior to the Effective Date, Executive was a participant in the Company’s Executive Officers’ Change of Control Incentive and Severance Benefit Plan (the “CIC Plan”) and the Company’s Vice Presidents’ Severance Benefit Plan (the “Severance Plan”). Effective as of immediately prior to the Effective Date, Executive shall no longer be eligible to participate in the CIC Plan or the Severance Plan.
