Prior Servicer Information. The Company acknowledges and agrees that the Transferor may not have access to information from servicers of an Asset prior to the appointment of the FDIC as receiver of the Failed Bank and that the Transferor has not requested any information not in the possession of the Transferor or its servicing contractor from any prior servicer of an Asset. The Company acknowledges and agrees that the Transferor will not be required under the terms of this Agreement to request any information from any prior servicer.
